Place Your Boat into Charter!

YOUR YACHT AS A TAX DEDUCTION

What Savvy Yacht Owners Have Known For Years

Owning a new yacht is a great experience and the fun of owning it shouldn’t be diminished by the difficulty of paying for it. For years savvy yacht buyers have recognized that there is a completely legitimate way to significantly reduce the cost of owning a yacht by structuring ownership in a manner that allows you to write-off the purchase price of your yacht and deduct most ownership expenses (insurance, slip fee, maintenance) against your employment income. This can be done by placing the yacht in charter while still having it available for your use and following some basic tax law guidelines. In addition to providing a tax shelter, your yacht will also generate charter income to help offset ownership expenses.

Before reading on, we want you to understand that we are talking about placing your yacht in charter with a local charter company right here in California in a marina convenient for you. We’re not talking about placing a yacht in charter in some foreign destination (Caribbean, Mexico, South Pacific) where you will rarely have the opportunity to use it.

Your Boat As A Business

First, let’s discuss the tax benefits of placing a yacht in charter and then we’ll discuss whether this will work for you. The key to understanding why yachts placed in charter can generate significant tax benefits is that these are the same tax benefits available to businesses for the purchase of business equipment. By placing your new yacht in a charter management program you are converting it from a personal asset to a business asset, essentially an equipment rental business. The relationship between you and the charter management company is structured so that you own the yacht and they assist you in managing your yacht rental business.

In recent years, Congress has significantly expanded the tax benefits available to businesses for equipment purchases in order to help stimulate the economy. These tax benefits are not available to people who own a yacht strictly for pleasure. While placing your yacht in charter changes the classification of it for tax purposes from a “personal” to a “business” asset, it does not prevent you from using your yacht.

At Cruising Yachts we have been placing new Jeanneaus and Hunters in charter for years and have seen these yacht owners reduce the costs of purchasing and owning their yacht by OVER 50% in many cases through a combination of tax deductions and charter income. Actual savings vary depending on the size of the yacht and the location in which it is placed in charter. Charter fleets in California and throughout the country, of which there are many with hundreds of yacht in charter, wouldn’t be in business if this arrangement did not withstand IRS review. Many of these charter companies have been in business for 20 years and longer.

Tax Shelter and Cash Flow Advantages of Charter Ownership

Here is a summary of the tax and income benefits available to the owners of new yachts purchased and placed in charter in 2012:

Under Section 179 of the Internal Revenue Code, you can take a one-time expense deduction in the year of purchase equal to the purchase price of your yacht up to a maximum deduction of $139,000. This benefit is reduced for yachts priced over $560,000 (a subject beyond the scope of this article); plus
You also can take a bonus depreciation deduction in the year of purchase of 50% of the amount of the purchase price over $139,000; plus
You can depreciate the adjusted cost basis of your yacht (the balance of the purchase price after deducting the Section 179 expense deduction and 50% bonus depreciation deduction) over 10 years; plus
You can deduct against your charter income and other employment income all ordinary and necessary charter related expenses including, for example, slip fees, insurance, repairs, loan interest, property tax, etc.; plus
You will receive income from the charter of your yacht, the amount of which varies depending on the size of your yacht and the charter company you use.

As an example, on the purchase of a $350,000 yacht placed in charter in 2012, the total deduction available to you under paragraphs 1 – 3, above, is $265,600 resulting in a savings of $92,650 just in the year of purchase alone (assuming you are in the 35% tax bracket and can utilize the full deduction). This substantial tax deduction is an attractive tax planning opportunity if you are a highly compensated individual or receiving a large bonus or other large payment of ordinary income from active employment or the active conduct of a trade or business. It is not available to offset passive rental income, capital gains or IRA withdrawals.

AND THIS MAY BE THE BEST NEWS OF ALL..… the Section 179 and Bonus Depreciation deductions are exempt from the AMT calculation!

Professional Maintenance and Support

Placing your yacht in charter also is an excellent way to ensure that it will receive professional maintenance, service and care. Yachts in a charter fleet typically are washed weekly and cleaned inside and out after each charter. Routine maintenance is performed on a regularly scheduled basis and damage promptly repaired. For you, as the yacht owner, it means that you can spend your time sailing your yacht and not doing cleaning, maintenance and repairs.
Your charter management company will require that every charter customer demonstrate that they are qualified to operate the yacht being chartered in order to minimize the potential for any damage. Damage caused by a charter customer, up to the amount of the insurance deductible, is paid for by the damage deposit (cash or credit card) they make up front when chartering the yacht.

Is Charter Ownership Right For Me

In deciding whether charter ownership is right for you, ask yourself three questions:

Am I paying income tax on taxable wages or salary from my work or business?
Do I have a limited amount of time to use my yacht?
Am I willing to allow qualified people to charter my yacht when I’m not using it?

If the answer to these questions is “yes” or “maybe”, then charter ownership is something you should consider. The reality is that most people use their yacht once a month, on average, leaving the balance of the month available for charter. Besides, if the yacht is paying for itself, it relieves the pressure some people feel to be constantly using it because of the cost. This actually lends to the enjoyment of the yacht when they do use it.

(b) Placing a yacht in charter won’t enable you to afford a yacht that is well beyond what you might otherwise be able to afford. The Selene 60 is a completely new design from an entirely new mold. The Selene 60 features a full-height engine room, European transom, and a full-width utility room for work, storage, electrical systems and washer/dryer. I WANTED TO SHAREWITH YOU THAT WE STILL HAVE 45 DAYS LEFT TO TAKE ADVANTAGE OF SECTION 179 TAX BREAKS!

Charter Boatonomics 101

How you can own a new boat, significantly offset of your cost, and save a fortune in taxes AND YES, HAVE FUN!

In this email, I'll give you an overview of how you can accomplish everything on the statement above. If in my efforts to be brief, if anything isn't clear or if you would like more detail, please feel free to give a call and I'll gladly go into more detail with you.

Let's make this real right from the beginning. Owning a charter boat isn't going to make you rich. Some boats do better than others, but at CYC our goal is to only put boats into our fleet, which will be economically, viable. That usually means your boat pays its way, covering all of its expenses, debt service, and generating strong positive after-tax cash flow. If you place a boat with us, it's likely going to be a long-term relationship, from 3-10 years, so we want this to be a "win/win." With those expectations in mind, here are some general selection rules to help you choose the right boat for you:

1. Choose the boat you want to own - I can often tell you how one model did vs. another in the past, but I can't predict the future. Frankly, the difference in economic performance isn't usually sufficient to justify purchasing one boat over another, especially if it means you're buying a boat you don't want. A very big benefit to our program is that it lets you use charter income and tax savings to pay for a substantial portion of the cost of buying your new boat. 2. Think like a charter client - Let's say you want to have a long weekend getaway in Catalina and want to take another couple with you. This is a popular type of charter and most couples will want privacy. They'll choose a yacht with two large staterooms, each with their own head. There are plenty of markets to be addressed. Call me and I'll fill you in on the models that best fit your desires.

3. Middle market boats - Chartering requires credentials and more folks have basic to mid-level credentials than the higher certification levels. In other words, it's a classic pyramid. To hit this market hard, I have developed certain models that do significantly better than others. Any of theses models will be well received in the charter market.

4. Up and Coming Boats - Let's talk Bali Catamaran's, and Mono-hulls, because the destination charter companies are becoming very Cat centric and with captains on board with customers they are gaining excellent popularity. We have access to the Bali brand with models in the 4.0 to 5.4 foot range. In addition to the Bali Catamarans we offer a complete line of mono-hulls from Jeanneau, Elan, and Tartan that have been well accepted in the charter industry. Financing Your Boat

I was reading a financial newsletter the other day that stated home mortgage rates are still at historic lows. Boat loan rates are also at some of the lowest they've ever been and are running as low as 4.00% to 4.50% based on FICA score.

These are not "teaser" rates. They are fixed for the full 15-20 year term of the loan and there are no points, fees, or prepayment penalties. And yes, we can help you get these rates through our own financing contacts.

Chartering Your Boat

This part is really important! There are several major ways to go about this and I'll cover them from worst to best:

1. Do It Yourself - This is an exercise in frustration and if you get audited (very likely), I can practically guarantee you'll lose. I won't belabor why here, but you can call me if you want details.

2. Place Your Boat In The Caribbean - Or Med, or South Pacific, etc. If your goal is to have some great vacations by trading boat time, this is a good plan, but the tax benefits were pretty much done away with in 1986. Also, beware of resale value. Not only are these boats "charter-centric," (too many cabins and too vanilla), but there's usually a lot of them for sale and very time consuming to get to locations resulting in low resale values.

3. 4. Do Your Homework! - I was recently speaking with a client who bought a boat in the Caribbean. As he described all of the terrific tax benefits he would be receiving, I had to bite my tongue because he had been seriously misled. Overseas charter boats are defined in the tax code as "passive investments," which means the deductions can only be used to offset passive income.

Offshore Delivery

Looking to save money on sales tax? Consider an offshore delivery. What is an offshore delivery? Read on.
An offshore delivery is when a client chooses to take delivery of their boat in a location outside of California, in order to use the boat in a location outside of California. The biggest advantage of this decision is that the buyer does not have to pay sales tax (which is about 9% of the purchase price).

In order to take advantage of this break in sales tax, the buyer must follow very specific rules and not appear to intend to bring the boat back to California, or appear to be keeping it out of state specifically to avoid the sales tax.

Performing an Offshore Delivery

Here’s how it usually works. We will take your new boat three miles off the shore of Point Loma where you are in international waters. We will document this by taking pictures of the GPS location, the day’s newspaper to verify the date, a picture of you behind the helm, and photos of the exchange of final payment. We’ll then go back to shore and submit all required paperwork and get it notarized. You will then provision your vessel before you take it into Mexico shortly thereafter. You will be required to keep your vessel in Mexico for 6 months to 1 year, depending on your state of residence. Here are some Key Points of Offshore Delivery

The Purchase contracts (new or brokerage) must state that the offshore delivery as a contingency.
The purpose is not to avoid sales tax.
You should not keep your current slips or anything that could be argued that you intend to return to California.
California buyers must keep the boat out a minimum 365 days.
The client must keep all records of usage out of the state to verify it has been used not stored. There is no specific usage amount required by the state; however we suggest you use it as much as possible.
The owner can not use the boat or put equipment on it until he has taken delivery out of the state.
